Are you ready for the new HMO Rules from 1st October 2018?

Houses in Multiple Occupation [HMOs]* appear to be on the rise and it seems the government is clamping down a bit and making it harder to obtain a license. This may seem a bit harsh but it does ensure the health and welfare of the occupants are considered which is important. What is also interesting to note is that many local authorities are removing Permitted Development rights in certain areas to prevent houses being converted to a HMO without planning permissions being needed. This is called an Article 4 Direction.
Some key updates to know about:
If you are a HMO landlord and you don’t already have a license you may need a license. If you need a license and are found to be without a license you will be committing a criminal offence. If you are convicted the non-compliance fines are unlimited but often in the region of £20-30, 000. There are various compliance checks but it is best to check with the Environmental Health department of your local authority.
Mandatory National Requirements
There are now mandatory national sleeping room sizes but local authorities also have their HMO requirements which may be larger than the national minimum.
  • 6.51 m² for one person over 10 years of age.
  • 10.22 m² for two persons over 10 years of age.
  • 4.64m² for one child under the age of 10 years.
Refuse Disposal
HMO landlords must ensure there are appropriate facilities for storing rubbish that their tenants generate. This will need to comply with their local authority’s storage and disposal of domestic refuse scheme.
Existing HMO Licenses
If you already have an existing HMO licence it should remain valid, automatically being transferred into the mandatory HMO scheme from 1st October 2018. Unless inspection forms part of your licence, your local association will not be required to inspect your property. However, you need to think ahead – and your local authority should provide the necessary information about future requirements that will need to be met. When your current licence expires, you will need to apply for a new license and the new conditions will be unavoidable.

*A HMO is effectively a shared house where different unrelated people or families share a house together, with separate bedrooms but sometimes shared amenities like Sitting Rooms, Kitchens and Bathrooms. Typical examples would be a shared student house or a house shared by young professionals.
